These Terms of Service ("Terms") govern your use of the Luminate salon management software ("Service") provided by Luminate ("we", "us", "our"). By accessing or using the Service, you agree to be bound by these Terms.
2. Service Description
Luminate provides cloud-based salon management software including appointment scheduling, client management, point of sale, staff rostering, and related features. The Service is provided on a software-as-a-service (SaaS) basis.
3. Account Registration
To use the Service, you must:
- Register for an account with accurate information
- Be at least 18 years old or have legal authority to enter contracts
- Keep your login credentials secure
- Notify us immediately of any unauthorised access
You are responsible for all activity under your account.
4. Free Trial
We offer a 30-day free trial. During the trial:
- Full access to all features is provided
- No payment details required until you subscribe
- Trial accounts may be terminated at any time
- At the end of the trial, you must subscribe to continue using the Service
5. Subscription & Payment
Subscriptions are billed monthly. By subscribing, you authorise us to charge your payment method on a recurring basis until you cancel.
Prices may change with 30 days' notice. Continued use after a price change constitutes acceptance.
6. Cancellation & Refunds
You may cancel your subscription at any time through your account settings or by contacting us.
- Cancellation takes effect at the end of your current billing period
- You retain access until the end of the paid period
- Subscriptions are non-refundable
- No refunds for partial months or unused time
7. Service Availability
We aim to provide 99.9% uptime for the Service, excluding:
- Scheduled maintenance (notified in advance where possible)
- Circumstances beyond our reasonable control
- Issues caused by third-party services
We do not guarantee uninterrupted or error-free service.
8. Your Data
You retain ownership of all data you input into the Service ("Your Data").
We will:
- Process Your Data only to provide the Service
- Maintain appropriate security measures
- Not access Your Data except as necessary to provide support or as required by law
Upon termination, you may export Your Data for 30 days. After this period, we may delete Your Data.
9. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Transmit malicious code or attempt to breach security
- Interfere with other users' access to the Service
- Resell or sublicense the Service without permission
- Use the Service to send unsolicited communications (spam)
We may suspend accounts that violate these terms.
10. Intellectual Property
We retain all rights to the Service, including software, design, and documentation. You receive a limited, non-exclusive licence to use the Service during your subscription.
You retain ownership of Your Data and any content you create.
11. Limitation of Liability
To the maximum extent permitted by law:
- Our total liability is limited to the fees you paid in the 12 months preceding the claim
- We are not liable for indirect, incidental, or consequential damages
- We are not liable for loss of data, revenue, or business opportunities
These limitations apply regardless of the form of action.

You agree to indemnify us against claims arising from:
- Your use of the Service
- Your breach of these Terms
- Your violation of any third-party rights
13. Changes to Terms
We may update these Terms from time to time. Material changes will be notified via email or the Service. Continued use after changes constitutes acceptance.
14. Termination
We may terminate or suspend your account if you:
- Breach these Terms
- Fail to pay subscription fees
- Engage in conduct harmful to us or other users
Upon termination, your right to use the Service ends immediately.
15. Governing Law
These Terms are governed by the laws of England and Wales. Disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
